Plaintiff and defendant settled a burglary loss in the amount of $6,226.24. This was the sum for which the proof of loss was submitted and for which a release was given. Subsequently, plaintiff brought an action in assumpsit for a supplemental payment in the amount of $8,425.56. Defendant, after a course of pleading had pretty well established an agreed set of facts, moved for judgment on the pleadings. Judge McCune conducted that proceeding...
