This case involves the question whether plaintiff was a guest under section 321.494 of the Iowa Code at the time of his injury. It was a one-car accident in which the plaintiff was a passenger and the defendant, Clifford Stoutner, was the driver. They were the only occupants of the car. Boyd Stoutner owned the car and was made a defendant as owner. The accident occurred on a gravel road covered with ice and snow. The car went into a ditch at a turn...
