1. Where the petition, answer, and general and special demurrers to the petition were all filed prior to the advent of the Civil Practice Act, it was not an abuse of discretion for the trial court to deny a motion to dismiss the demurrers and to proceed on the basis of the pleadings as they existed at the time the new procedure went into effect.
