The appellant here, Fern Kelley, instituted an action in the Boone Superior Court against Carolyn Persinger and Larry Richard Skeen for damages for personal injuries resulting from a collision between the Persinger car and the Skeen car. The appellant, plaintiff below, was a passenger in the Persinger car at the time of the accident. She was riding with other passengers in the Persinger car as part of a car pool.
