PYATT v. MERCER

No. 2296.

209 So.2d 320 (1968)

Geraldine PYATT, Plaintiff-Appellee, v. Dewey L. MERCER et ux., Defendant-Appellant.

Court of Appeal of Louisiana, Third Circuit.

February 7, 1968.

Attorney(s) appearing for the Case

Holt & Woodley by Edmund E. Woodley, Lake Charles, for defendant-appellant.

Francis E. Mire, Lake Charles, for plaintiff-appellee.

EN BANC.

PER CURIAM:

Plaintiff-appellee moved to dismiss the suspensive appeal on the grounds that the defendant "failed to post a bond for a suspensive appeal as the law directs." No further explanation of the reasons for the motion is given.

We find the record contains a suspensive appeal bond, which, on its face, is proper. The motion to dismiss the suspensive appeal is denied.
