Mr. JUSTICE WARD delivered the opinion of the court:

John Eveland, the appellant, pleaded guilty in the circuit court of Randolph County to a charge of theft and was sentenced to the penitentiary for a term of 3 to 5 years. His later petition seeking relief under the Post-Conviction Hearing Act (Ill. Rev. Stat. 1967, chap. 38, par. 122-1 et seq.) was denied by the trial court and he now appeals to this court from such denial.
