OPINION

WILLIAM M. TAYLOR, Jr., District Judge.

On June 11, 1959, Harold Eidinoff was indicted by a grand jury in El Paso County, Texas, for the offense of murder with malice in the shooting death of one Theodore Andress. On Eidinoff's motion for a change of venue the district court in El Paso transferred the case to Lubbock, Texas. Eidinoff filed a motion requesting a pre-trial hearing on the issue of his sanity at the time he committed the shooting.
