GERALD McLAUGHLIN, Circuit Judge.

Appellant, Carmine DiPaolo, seeks reversal of the judgment below denying his petition for a writ of habeas corpus.

Appellant was indicted for first degree murder. He entered a plea of not guilty and after a trial by jury was found guilty and sentenced to life imprisonment. His conviction was affirmed by the New Jersey Supreme Court. State v. DiPaolo, 34 N.J. 279
