Copeland, hereinafter referred to by name or as plaintiff, brought an action against Emma Baldauf, to whom we will refer by name or as the defendant, in which he sought to recover damages resulting from an automobile accident allegedly caused by the negligence of defendant. The accident occurred on U. S. Highway 87 between Denver and Colorado Springs on July 2, 1964.
