On August 31, 1966 the Commissioner of Public Safety suspended the driver's license of Wayne Francis Kern effective September 30, 1966. Mr. Kern appealed. After trial on appeal defendant Ed J. Kelley, Judge of the Hamilton County District Court, vacated the suspension. Upon proper application writ of certiorari issued from this court ordering defendant judge to make return thereto.
