Defendant was charged by information in count I with a violation of section 487, subdivision 3 of the Penal Code (grand theft of an automobile), and in count II, with a violation of section 496 of the Penal Code (receiving stolen property). Defendant pleaded not guilty and requested a jury trial. After a trial by jury, defendant was found guilty of violation of section 496 of the Penal Code, and not guilty as to the other count.
