Appellant Frank Roswell Moorman III was convicted by a jury on five counts of violating the Universal Military Training and Service Act. He was sentenced to serve five years concurrently on each count. Counts I, II and III charged him with failing to report for an armed forces physical examination on June 28, 1965, August 2, 1965 and July 5, 1966, respectively.
