Clarence Thomas Neece during his lifetime was a carpenter and was employed by the respondent Frank Neece Fence Company, a company operated by his son. On 22 September 1965, Clarence Thomas Neece, hereafter referred to as the deceased, was 64 years of age. The respondent company was a fence building contractor, part of its work being the construction of block fences and the construction of redwood fences.
