Robert Lee Smithson, the appellant, was convicted of armed robbery by a jury in the Circuit Court for Allegany County. He was sentenced to a term of ten years to run concurrently with a sentence of ten years for larceny of an automobile. He was tried jointly with John David Lease and John Leroy Beeman.
