This is a claim for the appropriation of claimants' land pursuant to section 30 of the Highway Law.

During the course of the trial claimants' counsel called the State's Senior Rights of Way Agent as a witness. He elicited from said witness that a prior appraisal had been prepared for subject property by a staff appraiser. Said appraisal was marked for identification but was not offered in evidence, although claimants' counsel...
