HAMMOND, C.J., delivered the opinion of the Court.

The appellant, Eschinger, owns one hundred acres of land fronting on Brewer's Creek, a tributary of the South River in Anne Arundel County. In 1956 he was granted a rezoning of 1.44 acres at the waterfront from agricultural to heavy commercial to permit the building of a marina. The surrounding ninety-eight acres plus remained agricultural.
