OPINION

KELLEHER, Justice.

This indictment for murder was tried before a justice of the superior court sitting with a jury. The jury returned a verdict of guilty of murder in the second degree. Thereafter, the trial justice denied the defendant's motion for a new trial and sentenced him to serve 25 years in the adult correctional institutions. The case is before us on the defendant's bill of exceptions.
