Plaintiff, Martin Bagley, brings this tort action individually and on behalf of his minor daughter, Starr Anne Bagley, to recover damages for personal injuries sustained by Miss Bagley in an accident which occurred while she was riding as guest passenger in an automobile insured by defendant Commercial Union Insurance Company of New York (Commercial) and being driven by Robert A.
