Defendant Leon Ellsworth Griffes was convicted of having made an indecent exposure as a sexually delinquent person and sentenced to a prison term of from one day to life. The pertinent statutory provision is CLS 1961, § 750.335a (Stat Ann 1954 Rev § 28.567[1]) which states:

"Any person who shall knowingly make any open or indecent exposure of his or her person or of the person of another shall be guilty of a misdemeanor, punishable...
