This is a tort action based on a maritime accident. On October 21, 1964, the trawler "Captain Ricky", owned by the plaintiff, Lenias J. Dupre, while trawling in Terrebonne Bay, picked up in its propeller the metal cylinder of a navigation light. The action of the propeller apparently drove the cylinder through the hull of the boat above the propeller, causing the boat to sink.
