Defendant assigns as error the court's denial of his motion of compulsory nonsuit at the close of the State's evidence and at the close of all the evidence.

C. J. Williams, a witness for the State, testified that he is a detective sergeant with the Raleigh Police Department and was on duty as such on 15 October 1967. That at about 9:00 p. m., while he and another officer were patrolling on Hoke Street, he observed a blue and white 1958...
