At the very outset we find it necessary to note that defendant has failed to comply with the rules of this Court. Defendant's appeal is submitted under Rule 19(d) (2) which permits the filing of the complete stenographic transcript of the evidence in the trial tribunal in lieu of setting out the evidence in narrative form.
