MR. PRESIDING JUSTICE McCORMICK delivered the opinion of the court.

Defendant was charged with attempted (murder). (Ill Rev Stats 1963, c 38, § 8-4.) After a bench trial he was found guilty and sentenced to a term of five to ten years.

In this court the defendant urges: 1) that the State failed to prove him guilty of the crime of attempted murder beyond a reasonable doubt; and 2) that he was denied due process of law because the trial court made a determination...
