The defendant and his brother were charged with the same offense. At the conclusion of the state's case, the trial court granted a motion to dismiss the action against the brother but denied a motion to dismiss the case against the defendant. The defendant was secretary-treasurer of both Laabs Dairy Company and the Laabs Cheese Company. Dairy plants must be licensed by the Wisconsin Department of Agriculture.
