The defendant, Edward Nelson, was convicted in a bench trial in the circuit court of Sangamon County under two counts of an indictment charging him with violating section 37 of the Uniform Narcotics Drug Act. (Ill. Rev. Stat. 1963, chap. 38, par. 22-39.) He was sentenced to the penitentiary for concurrent terms of 1 to 3 years on each of the counts. The Appellate Court for the Fourth District...
