On February 27, 1963 the third-party plaintiffs, appellees, entered into a preliminary sales agreement whereby they were to purchase a bar from the receiver for the estate which held the bar as an asset. The third-party defendant, appellant herein, a real estate broker, was also a signatory to the agreement and, as escrow agent, accepted appellees' deposit money of $1,000.
