NATURE OF THE CASE

Defendant has moved to quash the indictments. An answer to the motion was filed by the Commonwealth, and testimony received. From the testimony, the court finds the facts as follows.

On April 9, 1965, defendant was arrested on charges of embezzlement and conspiracy, and, after a preliminary arraignment, was held in $5,000 bail for a preliminary hearing, which was set for April 23, 1965...
