STATE v. KISER

No. 40766.

13 Ohio St. 2d 126 (1968)

THE STATE OF OHIO, APPELLEE, v. KISER, APPELLANT.

Supreme Court of Ohio.

Decided March 13, 1968.

Attorney(s) appearing for the Case

Mr. Melvin G. Rueger, prosecuting attorney, and Mr. Dominic Perrino, for appellee.

Mr. Henry E. Sheldon, for appellant.

O'NEILL, J.

The first question presented to the court is: Is the affidavit void on the ground that it does not state an offense under the laws of Ohio?

The defendant contends that the affidavit is fatally defective because it fails to state that the letter was sent or delivered with an intent to obtain from another person any money, article of personal property, or other thing of value.
