ONION, Judge.

The offense is Murder with Malice; the punishment assessed by the court after a verdict of guilty by the jury, ten (10) years confinement in the Texas Department of Corrections.

The indictment charged the appellant with shooting and killing his wife on March 27, 1954. Appellant's trial commenced on December 13, 1966. The record reflects that on December 15, 1954, in a separate sanity hearing, a jury determined that appellant...
