The defendant, John Pickett, was tried in a bench trial in the circuit court of Cook County for gambling on an indictment which charged him with possession of policy tickets and other similar devices in violation of section 28-1(a)(8) of the Criminal Code. (Ill. Rev. Stat. 1965, chap. 38, par. 28-1.) He was found guilty and sentenced to 5 years probation, the first 30 days...
