McQUADE, Justice.

The evidence showed that on March 12, 1967, a Sunday, at about 2:00 p.m., defendant Reyna entered Miller's Grocery and Jean and Elsie's Tavern, which is located on the northeast corner of the intersection of Highway 30 and Black Cat Road in Ada County.
