These cases were referred to Trial Commissioner William E. Day with directions to make findings of fact and recommendation for conclusions of law under the orders of reference and Rule 57(a). The commissioner has done so in an opinion and report filed on December 19, 1966. Exceptions to the commissioner's report and opinion were filed by plaintiff, briefs were filed by the parties and the cases were submitted to the court on oral argument...
