Appellant, John Riley Carnes, owned a coal loading ramp located on the right-of-way of the Louisville & Nashville Railroad Company in Manchester, Clay County, Kentucky. The ramp was 266 feet long, 24 feet wide, more than 10 feet high and contained 97,187 board feet of lumber. It had been used to load coal into railroad cars but this use had been discontinued sometime prior to April 7, 1966, when the ramp was destroyed by fire. On that date men...
