This is an appeal by the defendant from a conviction for second degree murder.

The appellant, Kenneth Eugene Zachmeier, was charged with the murder of his wife. The death of Mrs. Zachmeier first came to light on the afternoon of October 16, 1966, when defendant called his employer and friend, Guy Reese, from a bar in Billings, Montana, and asked Reese to come down and talk to him.
