KALODNER, Circuit Judge.

Following a jury trial, Bernard Grundy was found guilty on an indictment charging him with violation of the Universal Military Training Act1 in failing to comply with his draft board's order to report for induction into the armed forces of the United States. The trial court imposed a 5-year prison sentence and Grundy filed the instant appeal.
