On November 18, 1964, Alice Sargis, one of the plaintiffs in this action, was injured when the car in which she was sitting was struck by a tractor-trailer truck driven by the defendant, Carl Ervin Barnett. At the time of the accident, the defendant was an employee of the State of West Virginia and was acting within the scope of his employment.
