In this appeal appellant, Joseph Weldon Roberts, seeks review of the superior court's denial of his petition for a writ of habeas corpus.

On January 11, 1967, appellant was indicted for the crime of murder in the first degree. Seven days later appellant was arrested under a warrant which had been issued on the basis of this indictment. Then, on June 8, 1967, the superior court, on its own motion, dismissed the indictment...
