PER CURIAM:

Appellant sued in the District Court to recover damages under the Federal Tort Claims Act, 28 U.S.C. § 1346(b), for permanent disablement caused by a fall in the District of Columbia Jail allegedly due to defective shoes. In February of 1964 appellant was convicted of a federal crime in the United States District Court for the District of Maryland.
