This is an appeal, on leave granted, to the people of the State of Michigan from a denial of a rehearing by the Court of Appeals. In its order on which rehearing was sought, the Court of Appeals on its own motion reversed a judgment of conviction entered upon the defendant's plea of guilty.

The guilty plea was accepted by the trial court on July 24, 1962. A motion for a new trial was denied and delayed...
