The appellant, Johnny L. Thomas, and forty-nine others, was convicted in the recorder's court of the City of Eufaula, Alabama, for the offense of remaining at the place of an unlawful assembly after having been warned to disperse. Each defendant was fined $100.00. Appeal was taken to the circuit court where they were tried by the court without a jury. They were found guilty and fined $25.00 each.
