This is an action for disability retirement pay based upon provision of section 402 of the Career Compensation Act of 1949.1 Plaintiff is claiming disability retirement pay from March 15, 1952 (date of final separation from the Navy) to the present on the ground that he incurred a service-connected disability during his first tour of duty (8/15/37 to 12/9/45) which was aggravated by his second tour of duty...
