Faulkner Construction Company, a domestic corporation, hereinafter called "Faulkner," entered into written contracts, dated September 9, 1963, with Jack Ezon, appellant, for the construction of two apartment buildings in Austin, Texas, on property owned by Ezon, which apartment buildings are known as the Summit Apartments and the Nob Hill Apartments.
