Per Curiam.

The order denying the motion of defendant for a modification should be affirmed. The facts relevant to a proper disposal of the other issues in this case are relatively few. It appears that on December 30, 1929 the plaintiff entered into an agreement with the Village of Tupper Lake (hereinafter referred to as Village) whereby certain utility poles then existing would become jointly owned and each party would have the right to use such poles.
