SMITH, Justice.

Plaintiff brought an action under 12 VSA Chapter 167, the Declaratory Judgment Act, against the defendant insurance company, to the court of chancery for the County of Rutland, to determine liability under an insurance policy issued by the defendant company to the plaintiff, Clarence C. Fish. Plaintiff has brought his appeal here from the Decree below as well as to other rulings and actions taken by the Chancellor.
