In a case tried to the Court without a jury, Joseph Heljenek, a Jehovah's Witness, was found guilty of failure to perform a duty required of him under the Selective Service Act. 50 Appendix, U. S.C. §§ 456(j) and 462. The Selective Service Board had granted Heljenek exemption from military service as a conscientious objector (Class I-O) but denied him classification and exemption as a minister (Class IV-O).
