In June 1964 plaintiff Teleflex Incorporated (Teleflex) brought an action for a declaratory judgment determining that Patent No. 3,015,969 issued on January 9, 1962 to Otto J. Bratz and assigned by him to his employer, defendant American Chain & Cable Company, Inc. (ACCO), is invalid and that products manufactured and sold by Teleflex do not infringe the patent.
