This is an appeal from a judgment of the district court of Dunn County rendered in an action tried by the court without a jury. A trial de novo is demanded in this court.

The plaintiff was engaged in the hide, fur, and junk business at Mott, North Dakota. As part of this business, he took on the retail sale of a line of batteries from one Tony Schafer, of Bismarck, who was a distributor of batteries manufactured by the Waterless Battery Company...
