The plaintiff appealed to the Court of Common Pleas from a refusal of the defendant, the town planning and zoning commission of Bethany, for preliminary approval of its plan for a sub-division of its property. The court rendered judgment sustaining the appeal, and from that judgment the present appeal has been taken.
