This is an action of tort for personal injuries sustained by the plaintiff as a result of a motor vehicle accident. The accident involved an automobile in which the plaintiff was riding as a passenger and a tractor-trailer unit owned by the defendant Bay State Petroleum Co., Inc. and operated by the defendant William C. Foster.1

The jury returned a verdict for the defendant L and M
