This is a criminal action in which the defendant was charged in an information with second degree burglary and larceny contrary to the provisions of G.S. 1949 (now K.S.A.) 21-515 and 21-524. He was tried before a jury and convicted; thereafter he was sentenced by the trial court pursuant to the habitual criminal act to fifteen years on each count, the sentences to run concurrently.
